Step 2 – Arranging Your Finances

If you require finance, arranging a French mortgage is often the simplest and safest option.

One of the reassuring aspects of buying property in France is the legal protection offered to both buyers and sellers.
Once you’ve agreed a purchase price, the process usually follows these stages.
Making an Offer
Your estate agent will present your offer to the seller and negotiate on your behalf if necessary.
Once the offer is accepted, the legal process begins.
The Compromis de Vente
The first contract is called the Compromis de Vente.
This document sets out the agreed terms of the sale, together with important Clauses Suspensives (conditions that must be satisfied before the sale can proceed). These commonly include obtaining a French mortgage, planning permissions or other legal requirements.
At this stage, buyers normally pay a deposit of around 10%, which is held securely by the notaire.
Should one of the agreed conditions not be met, your deposit is normally returned in full.
The Notaire
Every French property purchase is overseen by a Notaire, an independent public official responsible for ensuring the transaction is legally correct.
The notaire carries out all legal searches, verifies ownership, prepares the contracts and safely holds the purchase funds until completion.
Completion – The Acte de Vente
Once all legal checks have been completed, finance is in place and the purchase funds have been transferred, everyone meets to sign the Acte de Vente, the final deed of sale.
Congratulations – you are now the legal owner of your French property.
If you cannot attend in person, a Power of Attorney can usually be arranged so that the notaire can sign on your behalf.
